Terms of Service

Welcome to Arcade Sandbox (the “Service”, “we”, “us”, or “our”), an online platform where you describe a game in plain words, our AI builds a playable HTML5 game, and you can publish it to a public arcade for others to play. By accessing or using the Service you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Service.

1.Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms. By using the Service you represent that you meet these requirements and that all information you provide is accurate.

2.Your account

You sign in using Google. You are responsible for activity that occurs under your account and for keeping your Google credentials secure. We are not liable for loss arising from unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.

3.Tokens & payments

Tokens are prepaid digital credits used to build and revise games. Prices are shown at the point of purchase. Building a game and revising a game each cost a number of tokens displayed in the interface, which we may change from time to time.
Tokens have no monetary value, are not a substitute for currency, and (except where creators cash out earned tokens as described in Section 6, or where required by law) are non-refundable. Purchased tokens do not expire.
Payments are processed by Stripe. We do not receive or store your full card details. Your purchase is also subject to Stripe’s terms.
Tokens are consumed when a build or revision runs. If a generation genuinely fails on our side, we will make reasonable efforts to refund the tokens for that generation.

4.Creating games & AI-generated content

Games are generated by an AI model based on the text prompts and change requests you provide. AI output is probabilistic: we do not guarantee that any game will be correct, complete, bug-free, fit for a particular purpose, or match your expectations. You are responsible for the prompts you submit and for reviewing any game you publish. Your prompts and game content are sent to our AI provider (Anthropic) to operate the Service, and may be processed to provide, secure, and improve the Service as described in our Privacy Policy.

5.User content & the Arcade

As between you and us, you retain ownership of the games you create. By creating, publishing, or otherwise submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and make your published content available to others through the Service (including the public arcade and embeddable/shareable links), for the purpose of operating and promoting the Service.
Publishing a game makes it publicly accessible. You are responsible for the content you publish and represent that you have the rights to do so.
All content must be lawful and family-friendly. See Section 7.
We may remove, unpublish, or refuse any content, and may change how the arcade is organized or presented, at our discretion.

6.Creator earnings & payouts

When a player unlocks your published game, you may be credited earnings (in tokens) as described in the interface at that time. Where cash-out is offered, you may convert eligible earned tokens into money at the rate shown, subject to any minimums, identity verification, and onboarding through our payments partner (Stripe Connect). Payouts may be unavailable in some regions. You are solely responsible for any taxes on amounts you receive. We may modify or discontinue earnings and payout features, and the associated rates, with reasonable notice where practicable.

7.Acceptable use

You agree not to use the Service to create, publish, or distribute content, or to behave in ways, that:

are illegal, infringe others’ intellectual property or privacy, or violate any law;
are sexually explicit, hateful, harassing, violent, or otherwise not family-friendly;
contain malware, attempt to exfiltrate data, mine cryptocurrency, phish, or otherwise harm players or their devices;
attempt to bypass the Service’s sandboxing, security, payment, or token systems, or to make requests to external servers from within a game where prohibited;
scrape, overload, disrupt, reverse engineer, or gain unauthorized access to the Service; or
impersonate others or misrepresent your affiliation.

8.Intellectual property & takedowns

The Service itself — including its software, design, branding, and content we create — is owned by us or our licensors and protected by law. If you believe content on the Service infringes your rights, contact us at support@arcadesandbox.com with enough detail to identify the content and your claim, and we will review and act appropriately, including removing infringing material and terminating repeat infringers.

9.Third-party services

The Service relies on third parties including Google (sign-in), Stripe (payments and payouts), Anthropic (AI generation), and Cloudflare (hosting). Your use of the Service may be subject to their terms, and we are not responsible for third-party services.

10.Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED GAMES WILL MEET YOUR REQUIREMENTS.

11.Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

12.Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or of any law or third-party right.

13.Termination

You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

14.Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.

15.Governing law

These Terms are governed by the laws of [your jurisdiction], without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there, except where applicable law grants you rights that cannot be waived.
